NOTICE OF PUBLIC HEARING/CONSULTATION
Pursuant to Sections 401/402 of the Tariff and Customs Code of the
Philippines (TCCP), as amended, the Tariff Commission will conduct
public hearing/consultation on the implementation of the 2012 version of
the ASEAN Harmonized Tariff Nomenclature (AHTN) to form part of
Section 104 of the TCCP. The 2012 version of the AHTN nomenclature
consists of approximately nine thousand five hundred and sixty six
(9,566) lines. The schedule of said public hearing is on
06 December 2011 (Tuesday) at 9:00
a.m. at the Tariff Commission Conference Room, 5/F Philippine Heart
Center Building, East Avenue, Diliman, Quezon City.
A copy in pdf format of the 2012 AHTN lines for public
hearing/consultation, including the alpha codes (9th digit
level), is now available for downloading at our website at
www.tariffcommission.gov.ph/ahtn2012public-hearing.htm.
We enjoin / invite all parties to state their positions and comment on
the lines of interest to them.

In
accordance with Section 10 of the Rules and Regulations to
Govern the Conduct of Investigation by the Tariff Commission
pursuant to R.A. 8800 (otherwise known as “The Safeguard
Measures Act”), notice is hereby given that Public Hearing

NOTICE OF FORMAL INVESTIGATION
Pursuant to Section 19 of R.A. 8800,
otherwise known as the “Safeguard Measures Act”, notice is
hereby given that the petition of the Philippine Steel Angle
Bar Industry for the extension of the safeguard measure
against the importation of steel angle bars under HS Heading
Nos. 7216.2100 (2007 AHTN Subheading No. 7216.21.00),
7216.5011 (2007 AHTN Subheading No. 7216.50.10) and
7216.5091 (2007 AHTN Subheading No. 7216.50.10) is now under
formal investigation by the Commission. The formal
investigation commenced after the Secretary of Trade and
Industry endorsed the petition to this office on June 29,
2011.
A preliminary conference will be held on
July 14, 2011, 9 a.m.,
at the Tariff Commission Conference Room, 5th
Floor, Philippine Heart Center Bldg., East Avenue, Quezon
City. Matters for discussion include the schedule and
procedure of public consultation, the nature of
administrative and fact-finding proceedings, the
non-applicability of the technical rules of procedures in
the Rules of Court, the submission of parties’ evidence and
position papers, the non-availability of confidential
information, the timeframe of formal investigation and other
related matters necessary for the speedy disposition of the
case.

SUMMARY REPORT OF THE FORMAL
INVESTIGATION
BY THE TARIFF COMMISSION ON THE PETITION OF THE DOMESTIC
TESTLINER BOARD INDUSTRY AS REPRESENTED BY UNITED PULP AND
PAPER CO. INC. (UPPC) FOR THE IMPOSITION OF GENERAL
SAFEGUARD MEASURE AGAINST IMPORTS OF TESTLINER BOARDS FROM
VARIOUS COUNTRIES (S.G. INV. NO. 01-2010) PURSUANT TO R.A.
NO. 8800
In
accordance with Section 14 of R.A. No. 8800 (“Safeguard
Measures Act”), the Tariff Commission hereby causes the
publication of the summary of findings and conclusions, as
well as the recommendation on the above-cited investigation
which was concluded on November 24, 2010, the date of
receipt by the Office of the Secretary of Trade and Industry
of the Formal Investigation Report and recommendation
(confidential and public versions).
FINDINGS AND CONCLUSIONS:
The
Commission concludes that, in accordance with RA 8800 and
the WTO Agreement on Safeguards.
1. The domestic industry accounted for 63% of the
total domestic production of testliner boards from 2004 to
2009.
2.
Locally produced testliner board regardless of the
weight in grams per square meter is a like product to
imported
testliner board.
3. Testliner board was imported in significantly
increased quantities, both in absolute terms and relative to
domestic production, from 2005 through 2008. Imports
peaked in the first six (6) months of 2010.
4.
The domestic testliner board industry suffered and is
suffering significant impairment in its overall condition in
terms of shrinking market share; declining production and
sales; underutilization of rated capacity; and operating
losses.
5.
While there were other factors that contributed to
the impairment of the overall condition of the domestic
industry, increased importations of testliner board were the
substantial cause of the serious injury to the domestic
industry.
RECOMMENDATION:
The
Commission recommends a specific duty of P1,342/MT as
the form of the definitive safeguard measure. The duty was
calculated by comparing the weighted average landed cost of
imported testliner board with the weighted average domestic
selling prices of the locally produced counterpart. The
Commission took into consideration the most recent data
available, i.e., from 2008 to June 2010 which is the last
three (3) years of the POI.

PRESS RELEASE
The Philippines will jointly host the
ASEAN Experts Group on Competition (AEGC) Forum for the
“ASEAN Regional Guidelines on Competition Policy”
and the “Handbook on
Competition Policy and Law in ASEAN for Business”
on 12 November 2010 to be held at Mactan Function
Room, Edsa Shangri-la Hotel starting at 8:30 a.m.
The said event forms part of a series of
socialization forums in each ASEAN Member State (AMS)
scheduled in October and November 2010, for outreach and
promotion purposes, after the launching of the ASEAN
Regional Guidelines and Handbook on CPL in Da Nang, Vietnam
on 24 August 2010.
The Regional Guidelines aims to achieve the goal
of ensuring ASEAN as a highly competitive economic region,
as envisioned in the ASEAN Economic Community (AEC)
Blueprint, as AMSs endeavour to introduce, implement, and
develop CPL by 2015. On the other hand, the Handbook has
been developed to provide basic notions of substantive and
procedural competition law applicable in AMSs, in a language
easily understandable to regional and transnational
businesses engaged in commercial activities and services in
the ASEAN region, and to SMEs which are contemplating on
expanding their businesses in the region.
The forum will be attended by delegates from the nine (9)
AMSs; Philippine Executive, Legislative, and Judicial
Departments; business groups; academe; and media.
The event is organized by AEGC, ASEAN Secretariat and the
Philippines Tariff Commission, with funding support from
InWEnt (Capacity Building International, Germany).

This is to advise importers of
products covered by the Department of Trade and Industry -
Bureau of Product Standards (DTI-BPS) Import Commodity
Clearance (ICC) Scheme to have their importation inventoried
and sampled by BPS-recognized inspection bodies within three
(3) days after release of goods by the Bureau of Customs (BOC).
Importers who fail to comply with this requirement shall be
issued show cause order and the BPS may reserve the right
not to issue conditional release for their subsequent
shipments.

CLARIFICATION
ON THE APPLICABLE RATES OF DUTY ON PRODUCTS ORIGINATING FROM
CLMV (CAMBODIA, LAOS, MYANMAR AND VIETNAM) UNDER THE CEPT/ATIGA
Executive Order 850, issued on 23 December 2009, took effect
on 01 January 2010. EO 850 was issued in order to implement
the Philippines’ commitment to eliminate the tariff rates on
the remaining products in the Inclusion List in year 2010
under the Common Effective Preferential Tariff (CEPT) Scheme
for the ASEAN Free Trade Area (AFTA/ASEAN Trade in Goods
Agreement (ATIGA).
Under
Article 19 (Reduction or Elimination of Import Duties) of
ATIGA, Member States agreed, among others, to eliminate
import duties on all products in their Inclusion Lists by
2010 for ASEAN-6 (Brunei, Indonesia, Malaysia, Philippines,
Thailand and Singapore) and by 2015 for CLMV with
flexibility to 2018, in accordance with agreed modalities.
Under
the reciprocity principle (Article 22 – Enjoyment of
Concessions), products on which tariffs of the exporting
Member State have reached or are at the rate of twenty
percent (20%) or below, and satisfy the requirements on
rules of origin shall automatically enjoy the concessions
offered by importing Member States in accordance with the
provisions of Article 19.
Thus,
exports to the Philippines of products originating from
other Member States, including CLMV, are entitled to avail
of the Philippines’ CEPT/ATIGA zero duty provided that the
CEPT/ATIGA duty of that exporting Member State is 20% or
below.

Tariff Commission, pursuant to Section 22 of Joint
Administrative Order No. 01, Series of 2000 (Implementing
Rules and Regulations of Republic Act No. 8752 - The
Anti-Dumping Act of 1999), hereby notifies the conclusion
and/or termination of its formal investigation on the
above-cited anti-dumping petition. The Commission concluded
the investigation on 04 August 2010 and submitted its final
report of findings to the Secretary of Trade and Industry on
09 August 2010.
The Tariff Commission, in its final
determination, concluded that:
1. Locally
produced mosquito coil is a like product to imported
mosquito coil from Indonesia; and
2. Calculated
margin of dumping is 0.61% of export price.
The
margin of dumping being de minimis at 0.61% of export
price, the petition for anti-dumping measure against the
importation of mosquito coil from Indonesia is hereby
dismissed.

Pursuant to Republic Act No. 8800, otherwise known as the
“Safeguard Measures Act”, notice is hereby given that a
formal investigation is now being conducted by the Tariff
Commission on the petition of the Philippine Testliner Board
Industry for the imposition of a definitive safeguard
measure against the importation of testliner board (under
AHTN Sub-Heading Nos. 4805.2400, 4805.2510 and 4805.2590)
from various countries. The formal investigation commenced
after the Secretary of Trade and Industry, having made a
preliminary affirmative finding of import surge and serious
injury, endorsed the petition to this office on May 25, 2010
for formal investigation.
A preliminary conference will
be held on June 8, 2010 at 9:00 a.m. at the Tariff
Commission Conference Room, 5th Floor, Philippine
Heart Center Bldg., East Avenue, Diliman, Quezon City.
Matters for discussion include the schedule and procedure of
public consultation, the nature of administrative and

TC SECTION 401/402 PUBLIC HEARING/CONSULTATION SLATED
ON NOVEMBER 4, 2009
The Tariff Commission (TC) will conduct Section
401/402 public hearing/consultation on
November 4, 2009
on the petition of Petron Corporation for (1) the exclusion
or suspension of crude oil and petroleum products from the
coverage of ASEAN Trade in Goods Agreement (ATIGA) and the
ASEAN-Korea Free Trade Area (AKFTA), or (2) the reduction of
Most-Favored-Nation rate of duty from 3% to zero on imports
of crude oil and petroleum products. Likewise, Petron
requests that the 1% rate of duty on fuel ethanol
(implemented under EO 449 signed on July 22, 2005) be
reduced to zero. The impact on the downstream oil industry
of the full implementation of the zero rate of duty under
the AFTA-CEPT in January 2010 and Korea’s implementation of
the zero rate of duty on goods traded under the ASEAN-Korea
Free Trade Agreement (AKFTA) between 2010 and 2012 prompted
the petitioner to file for Section 401/402 petition.
Also on the same day, the Commission will hear
the request from the Ethanol Producers Association of the
Philippines (EPAP) to create or extract a separate tariff
line for Anhydrous Ethanol (in accordance with the
Philippine National Standard) for use as fuel in an internal
combustion engine or for motive power at a proposed rate of
duty of 20%. This is in line with the objective of
attracting investors in the area of fuel ethanol production
and assure them of tariff protection to this new industry.
The request of the Philippine Fishing Gear
Industries, Inc. to reduce the tariff rate on Polyamide 6
Resin (Nylon Chip) from 10% to 0% rate of duty will also be
considered during the hearing. According to the petitioner,
subject article, being not locally produced, is a main
component in the production of other needed raw materials
(Nylon Monofilament and Multifilament Yarns) to produce
Nylon Fish Nets and Twines.

Within five (5) calendar days from receipt of the

comparability and volume of increased imports. If no comment
is filed, then the factual findings on product comparability
and volume of increased imports as contained in the Staff
Report will be binding to the party who did not submit its
Comment.
The parties are required to submit to the Commission within
five (5) calendar days before the first day of the public
hearing a list of issues they want to explore in the public
hearing other than the issues on product comparability and
volume of increased imports. A party who does not submit a
list of issues is deemed to have no
controversial/contestable matter to raise, hence, will be
given less priority in the order of the parties who may ask
clarificatory questions during the public hearing.
Parties are also required to submit to the Commission the
affidavits of their witnesses three (3) days prior to the
public hearing, copy furnished the other parties.
All principal parties, counsels, affiants, deponents and
other interested parties should appear before the Commission

NOTICE OF PUBLIC
HEARING/CONSULTATION
Pursuant to Sections 401/402 of the Tariff and Customs
Code, as amended, the Tariff Commission will conduct a
public hearing/consultation on (a) petition to reduce the
duty rates on certain feed ingredients and (b) products
under the Sensitive and Highly Sensitive Lists of the
ASEAN China Free Trade Agreement on Trade in Goods which
can be liberalized by transferring them to the Normal
Track List. Schedule of the said hearing is on 04 March
2008, at 9:00 A.M., at the Tariff Commission Conference Room, 5th Floor
Philippine Heart Center Building,
