ORDER The local cold rolled steel coils/sheets (CRC) industry represented by the National Steel Corporation (NSC) has filed an anti-dumping case against the importation of CRC from Taiwan with the Department of Trade and Industry (DTI). The protest alleged that CRC are being imported from Taiwan at dumped prices and that as a result thereof causes material injury to the domestic industry producing like article. The period of investigation for dumping or price difference for this case covers import transactions for the period March 1998-May 1999. However, for the injury determination, the POI considered relevant information for the last three (3) year period i.e. 1996 to May 1999.
WHEREFORE, IN VIEW THEREOF, the Department of Trade and Industry, acting under paragraph f of Section 301 of the Tariff and Customs Code as amended by RA 8752 has made a preliminary determination of the protest and concluded that there is reasonable cause to believe that the imported CRC from Taiwan are being dumped and therefore material injury has been caused to the Philippine industry. As a consequence thereof, the corresponding anti-dumping bond will be imposed for a period of four (4) months from the date of issuance by the Bureau of Customs of the relevant Customs Memorandum Order (CMO) on the herein named exporters of CRC from Taiwan:
In view of the non-operation of the NSC as ascertained by the Tariff Commission last 08 November 1999, the imposition of the prescribed provisional duties shall be suspended until such time that the NSC can show that its CRC division is already on normal commercial operation. Let notice of this Order be published in two (2) newspapers of general circulation. Also, let notice of this Order be furnished the Department of Finance to inform him of the preliminary determination and the suspension of the imposition of the anti-dumping bond. At the same time, let individual notices be sent to all interested parties including the country member concerned. Let the records of the case be forwarded to the Tariff Commission for formal investigation.
