SUBJECT : Implementation of the Philippines on the Trade in
Goods Agreement Under the ASEAN-KOREA Free Trade Agreement (FTA)
pursuant to the Issuance of Certificate of Origin Form AK on
01 January 2008

IN LINE WITH the country’s commitment on international
agreement in the issuance of Certificates of Origin (CO)
under the ASEAN-Korea FTA Form AK, and in compliance to the
legal enactments of Executive Orders 638 and 639 (CMC
315-2007), the issuance of CO Form AK for export to Korea
shall take into force on 01 January 2008.
The CO Form AK is an accountable forms of the Bureau of
Customs and shall be available and distributed by the
General Services Division upon request from concerned Export
Division/Units in all Ports/Sub-ports this Bureau.
Be guided accordingly.

Attached is the Indorsement dated January 30, 2006 of
Undersecretary Gaudencio A. Mendoza, Jr., Legal and Revenue
Group, Department of Finance transmitting to this Bureau the
Department of Trade and Industry Order dated January 6,
2006, "IN THE MATTER OF THE REDUCTION OF THE DEFINITIVE
GENERAL SAFEGUARD MEASURES AGAINST THE IMPORTATIONS OF
CERAMIC FLOOR AND WALL TILES FROM VARIOUS COUNTRIES FOR THE
SECOND YEAR OF THE EXTENSION PERIOD." The Pertinent
portion of the decretal of which reads: "xxx Thus, the
definitive general safeguard measure of PHP 2.45/kg. shall
be imposed on the second year of the extension period. xxx".
For implementation.
Please confirm the disssemination of this Circular
throughout your offices within fifteen (15) days from
receipt hereof.

SUBJECT : SPECIAL SAFEGUARD DUTY ON
ONIONS UNDER HS 0703.10.00
Pursuant to the 1st
Indorsement dated 22 November 2004 of Undersecretary MA.
GRACIA M. PULIDO-TAN, Department of Finance, directing the
immediate implementation of Department Order No. 2 dated
16 November 2004 issued by the Department of Agriculture
in accordance with R.A. 8800, it is hereby directed that
all importations of onions wiht HS 0703.1000 from all
countries shall be imposed an additional Special Safeguard
Duty to be computed following the formula illustrated in
Annex A of said Department Order No. 2, copy attached.
Moreover, covered shipments entered into/withdrawn from
warehouses in the Philippines for consumption shall, in
addition to the regular Customs duties due thereon, be
subject to the aforestated safeguard duty, on a per
shipment to shipment basis. All concerned Customs
offices/units are enjoined to coordinate with the
appropriate DA offices/units for the proper application of
the formula.
It is
understood that shipments of onions which are in transit
prior to the publication of this Order shall be exempted
from the imposition of Special Safeguard Duty, provided
they arrive before the effectivity thereof.
This Order
supersedes CMO No. 40-2002 on the same matter.
This Order shall
take effect fifteen (15) days after the publication and
shall remain in force until revoked.

of Crude Petroleum Oils & Refined Petroleum Products to be
Levied 5% customs Duty Effective January 01, 2005
Attached
is a facsimile copy of the Certification issued by the
Secretary Vicente S. Perez, Jr. Department of Energy dated
November 26, 2004 informing the Bureau that
effective January 01, 2005, all importation of
crude oils and refined petroleum products except liquefied
petroleum gas (LPG) as listed in the attached Annex "A" of
Executive Order No. 336, entering Philippine customs
territory,
shall be levied 5% customs duty.
Please
confirm the dissemination of this circular throughout your
offices within fifteen (15) days from receipt hereof.
